In a recent revelation, a series of allegations have been leveled against St. Clair County  Judge John Tomlinson, suggesting potential violations of the Michigan Code of Judicial Conduct. These claims, if substantiated, could have significant implications for the judge’s tenure and the broader judicial system.

Among the allegations:

  • Judge Tomlinson reportedly did not disclose his association with his former law firm Fletcher Fealko Shoudy Francis PC, even as associates from the firm appeared in his courtroom.
  • There are claims of a lack of transparency regarding his familial relationship with recently terminated Friend of Court referee Caryn Vanderhuevel, who has reportedly made recommendations on cases presided over by Judge Tomlinson.
  • Accusations have emerged pertaining to the judge filing fraudulent forms with the State Court Administrative Office concerning delayed court matters.
  • There are concerns about the denial of state-mandated “good time” for contempt sentences and the ordering of consecutive sentences without statutory authorization.
  • Judge Tomlinson’s position on the board of the St. Clair County Child Abuse and Neglect Council, and organization that frequently appears in adversarial proceedings before his court has also been called into question.
  • Other allegations include delays in court business, apparent legal misjudgments, and potential failures to refer disqualification motions to the chief judge.

A review of the annual reports from the Judicial Tenure Commission indicates that even a single instance of such violations by a judge could lead to disciplinary action. Given the multitude of allegations against Judge Tomlinson, many are keenly awaiting the commission’s response.

These claims are not mere speculations. Documentation from the court itself reportedly supports each of these allegations, leaving little room for contestation. Some argue that Judge Tomlinson has long operated in a manner that disregards both state law and his ethical obligations, believing his judicial position grants him such latitude.

The broader legal community and the public are now left to grapple with these revelations. For those skeptical of the allegations, a comparison of the Michigan Code of Judicial Conduct, court rules, and the Judicial Tenure Commission’s annual reports might offer clarity. Seeking the perspective of legal professionals on this matter could also provide valuable insights.

As the situation unfolds, many believe that Judge Tomlinson’s tenure may be nearing its conclusion. Whether these allegations will lead to his departure remains to be seen, but they undeniably cast a shadow over his judicial career.

  1. My ex was ruled by him and got custody and was given her son regardless that they lied in court to get her her son who has now been hit with neglect charges cause judge put him in a child sex offenders home for 3 months and had a domestic violence case in which she was arrested just weeks before she was given her son for attacking a boyfriend after having cops called on her at least 25 times for domestic violence after she had also had domestic violence with other people including me. The judge also made it so he not supposed to see me cause they accused me of not doing stuff in time that I did but refused to bring up even though it was presented to the people that were supposed to do their job. Now her son lives at the babysitter house un able to be with me who raised him from birth and his mother don’t even want her daughter only wants her son cause he has disability which was made clear on multiple counts she don’t follow any of the court rulling and the judge still lets it slide.

To top it off he has also been her judge when she was in foster care and he was trying help her when she was younger and when her being arrested or stealing stuff or lying in court it was over looked since they changed judges she has now come under many charges that should of been done the first time
